Court Extends Deadline to File Claims Against Warranty Gold PDF Print E-mail

A federal bankruptcy court has extended the deadline for consumers who want to apply for refunds in the Warranty Gold bankruptcy.

Warranty Gold sold extended service contracts to car buyers across the nation. The service contracts sold by Warranty Gold, as well as other service contract providers, were insured by National Warranty Insurance Risk Retention Group, a company that is also bankrupt.

Consumers who bought Warranty Gold service contracts should file a Proof Of Claim Form with the bankruptcy court. Although the deadline for filing has been extended, the court has not set a new deadline as yet. To get updated information on the Warranty Gold bankruptcy process and the new filing deadline, consumers may visit the bankruptcy websites: www.warrantynews.com or www.warrantygoldcreditors.com.

Consumers should send in the Proof of Claim as soon as possible to be sure they do not miss the new deadline.

Warranty Gold
If consumers purchased a service contract from Warranty Gold, they are entitled to file a claim in Warranty Gold's bankruptcy case (case number 03-15721) for:

1) The cost of any auto repairs incurred on or before November 11, 2003; and/or

2) A pro-rated refund of the unused portion of their service contract if they purchased the contract before June 7, 2003.

If consumers have both kinds of claims, two separate proofs of claim need to be submitted.

To file a proof of claim, consumers should complete the �PROOF OF CLAIM� form (pdf file) and the �Warranty Gold, Ltd. Supplemental Claim Information Sheet� (pdf file).

After completing the forms, consumers should fax or mail these forms and any supporting documents to Warranty Gold.

National Warranty and Other Service Contract Providers
In addition to Warranty Gold, other service contract providers sold extended service contracts insured by National Warranty. The following companies, and possibly others, may have sold contracts to Minnesota consumers that were insured by National Warranty:

American Road Warranty
Intercontinental Acceptance Corp.
Consumer Automotive Consultants
Auto Union Warranty
Independent Warranty Management Corporation
Consumers Choice Warranty
Triad
Omni Auto
Alternate Financial Acceptance Corporation
Engine Parts Group
If consumers purchased a contract from one of these companies, and the company failed to pay the claim, customers may be entitled to file a claim in National Warranty�s liquidation case. In some states, service contract providers are required to obtain an insurance policy under which an insurer agrees to pay all sums which the provider is �legally obligated to pay in performance of its contractual obligations under the motor vehicle service contracts� it issued or sold.

At this time, the National Warranty claims process is not finalized. When a claim form is available, it will be posted on National Warranty�s website, www.nwig.com, along with the instructions on filing a claim.
